EPA Loosens Clean Air Act Rules for Data Center Power Plants

Across the United States, the rapid expansion of data centers has sparked concerns over rising electricity costs for residential and small business customers, as well as potential health and climate impacts due to increased reliance on fossil fuels. In response, some state officials have called for data centers to generate their own power. However, new guidance from the Environmental Protection Agency (EPA) suggests that these independent power plants may face fewer environmental safeguards.

On May 10, the EPA published guidance stating that the Clean Air Act’s Acid Rain Program does not apply to power generation facilities that operate independently from the larger electricity grid. This move is part of a broader effort to streamline regulations for data centers and their supporting power plants, according to experts.

The Acid Rain Program, established in 1990, targets sulfur dioxide and nitrogen oxide emissions from large power plants. Traditionally, it has applied to utility power plants supplying electricity to the public. While the EPA contends that islanded power plants were never covered by the program, the guidance removes one regulatory hurdle for these facilities.

The program’s monitoring and reporting requirements have contributed to significant reductions in sulfur dioxide and nitrogen oxide emissions from power generation since the 1990s. However, state agencies may now lose a key tool to track emissions from data center power plants, as local regulators will have to determine how to oversee these facilities.

The push for islanded power plants coincides with a surge in data center demand, driven by the rise of generative artificial intelligence. This demand has led to proposals for some of the largest power plants in the country, fueled primarily by natural gas. For example, OpenAI, Amazon, and Nexus have announced plans for massive gas plants in Ohio, Texas, and other locations.

State environmental agencies will still have the authority to issue permits for these projects, and the EPA’s guidance is not a binding rule. However, experts warn that the broader trend of federal policy changes could weaken environmental protections.

The EPA has also proposed a rule change that would exempt “minor” new pollution sources from public notice and comment requirements before permits are issued. While the agency states that this change would not alter emission standards or weaken protections, critics argue it could reduce transparency and community input.

Some data center power plants are already attempting to bypass local permitting. In Georgia, VoltaGrid and Serverfarm were issued violation notices for starting construction without permits. Meanwhile, a lawsuit by the NAACP alleges that xAI built a 495-megawatt power plant in Mississippi without obtaining permits to serve a data center in Tennessee.

As the utility sector races to meet data center demand with fossil fuel-powered plants, the proliferation of islanded facilities outside traditional regulatory controls raises concerns about environmental and public health impacts. The EPA’s guidance and proposed rule changes may further ease the path for these developments, leaving states and communities to fill the gaps in oversight.
